CUSTOMER POLICIES PAGE

When purchasing products from Pacific West Equipment, the buyer acknowledges, agrees and accepts the customer policies as stated herein.

ORDERING and PAYMENT

Customer understands that orders require payment in full before processing and shipping. Accepted payment is by credit card, certified check, money order, personal or corporate check. All checks must clear the bank before shipment. If product is not immediately available, the shipping date will be determined by the manufacturer and Pacific West Equipment will advise the customer of the expected ship date.

SHIPPING POLICY

After customer's order has been received, actual shipping cost for the order will be calculated for customer approval. Customer will be responsible for delivery costs including any expediting charges if applicable unless sold delivered FOB customers location.

SUITABILITY OF PRODUCTS

Products listed and sold by Pacific West Equipment are purchased with the expressed understanding that the purchaser and/or users are thoroughly familiar with the correct application and proper care. It is the buyer and end user's responsibility to determine the suitability of a product for any given use, to properly train anyone using the product, and to check and abide by all applicable federal, state and local regulations. Purchaser and user must read and understand all safety cautions and warnings before using any product purchased from Pacific West Equipment. Mark DeMoss dba Pacific West Equipment assumes no responsibility and shall not be held liable for any loss or damage caused by, or resulting from the misapplication or misuse of any product sold by Pacific West Equipment.

EXTENT OF CLAIMS

Customer agrees that the maximum liability of Pacific West Equipment on any claim resulting from a purchase, will be limited to the purchase price of the merchandise.

LEGAL DISPUTE

The laws of the State of California shall control as to all matters resulting of legal claim.

Warranty Policy

Pacific West Equipment, hereby states that all warranties are the responsibility of the individual manufacturer. Coverage, reimbursements and repairs will be dictated and implemented by each individual manufacturer per their individual warranty policy. We will do all in our power to assure our customers receive proper compensation per the manufacturer's written warranty policy. Pacific West Equipment will not be liable for any financial claims on a warranty deficiency or loss of use claim. Pacific West Equipment will not be responsible for any product warranty implied or assumed, beyond that of the original manufacturer's warranty.

PROPER USE OF PRODUCTS

Provisions of the manufacturers warranties will not apply to; products that are used for any purpose other than what they were designed for; that have been altered in any way that world be detrimental to the performance or life of the product; that are damaged from misapplication, misuse, negligence, lack of proper maintenance, or accident. These conditions are not covered by manufactures warranty, or any expressed or implied Pacific West Equipment warranty.

RETURNS

All sales are final unless received damaged or defective. Inspect all shipments immediately. Any merchandise that is received damaged must be reported within 72 hrs of receipt, external damage should be noted on delivery invoice or reject shipment. Goods that are defective may be returned within 30 days of purchase with appropriate notification to Pacific West Equipment and subsequent manufacturers "RGA" authorization for return.

We will accept returns of any unused stock inventory item with prior approval. Customer will be responsible for all delivery and return freight expenses and a 15% re-stocking fee. Credit will be issued within 1 week of receipt and inspection of the product. Special order items are not returnable

Products shipped by the error of Pacific West Equipment or any of it suppliers will be returned pre paid freight by a carrier of our choice and credited 100% back to your account. Please notify Pacific West Equipment and we will arrange return freight and secure the shipment of the correct product.

GOODS DAMAGED IN SHIPPING

1) When receiving merchandise thoroughly inspect packaging before signing Bill of Lading

2) Do not receive obviously damaged goods, don't sign or accept. Refuse delivery and contact us immediately.

3) If you suspect there may be shipping damage, make sure you Note it on the bill of ladin2 (take a picture of the damage if you can). Do not dispose of any packing material as you may need it if return shipment is necessary and these materials may be required for proof of damage against the freight company.

DEFECTIVE GOODS

Upon receipt of merchandise, thoroughly inspect the purchased product before using. Contact Pacific West Equipment immediately if the goods are found to be defective. All defective goods claims must be submitted within 30 days of delivery. A returns goods authorization (RGA #) must be obtained from Pacific West Equipment before returning any defective products.

To request RGA # please call (209) 704-4118, fax (209) 826-9206, or e-mail pacificwesteq@sbcglobal.net, with your invoice number and the reason for the return. These documents must accompany the return to the manufacturer.
